Terms and Conditions of Use

Article 1 – Definitions
In these terms and conditions, the following definitions apply: Withdrawal period: the period during which the consumer may exercise their right of withdrawal; Consumer: the natural person who is not acting in the exercise of a profession or business and enters into a distance contract with the trader; Day: calendar day; Extended transactions: a distance contract relating to a range of products and/or services, where the delivery and/or purchase obligation is spread over time; Durable medium: any means that allows the consumer or entrepreneur to store information addressed to them personally in a way that allows future access and unaltered reproduction; Right of withdrawal: the consumer's right to withdraw from the distance contract during the reflection period; Entrepreneur: the natural or legal person offering products and/or services to consumers; Distance contract: a contract concluded remotely using technology within a system organized by the entrepreneur; Means of distance communication: technology that allows conclusion of a contract without physical presence of both parties. General terms and conditions: these terms and conditions of the entrepreneur.

Article 3 – Applicability
These general terms apply to all offers of the entrepreneur and to all distance contracts concluded between the entrepreneur and the consumer. Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer. If not reasonably possible, the consumer will be informed where these terms can be accessed and that they will be sent free of charge upon request.
If the contract is concluded electronically, these terms will be provided in a way that allows them to be stored on a durable medium. If product-specific terms apply, they will be communicated in addition and prevail in case of contradictions. Invalid or unenforceable clauses do not affect the rest of the agreement.
Article 4 – The Offer
Offers with a limited validity period or under conditions will be explicitly stated. The offer includes a complete and accurate description of the products/services. Obvious mistakes do not bind the entrepreneur. Product images are indicative and may differ. Prices exclude customs clearance and import VAT. Additional charges by the postal or courier service may apply.
Article 5 – The Contract
The contract is concluded when the consumer accepts the offer and meets the stated conditions. The entrepreneur will confirm the electronic acceptance promptly. Until this confirmation, the consumer may dissolve the contract.
The entrepreneur must take appropriate technical and organizational measures to secure electronic data and payments. He may assess the consumer’s ability to meet payment obligations and may refuse orders for legitimate reasons. After concluding the contract, the entrepreneur will send confirmation including address, withdrawal terms, warranty, and service details.
Article 6 – Right of Withdrawal
The consumer may withdraw from the contract within 14 days without reason. During this period, the consumer shall handle the product carefully and return it unused, with all accessories and original packaging. Notification must be in writing (e.g., email to contact@newyorkwardrobe.com), and the return must occur within 14 days.
Article 7 – Costs in Case of Withdrawal
Return shipping costs are the consumer’s responsibility. Any amounts paid will be refunded within 14 days of cancellation, provided the goods are returned or proof of return is given.
Article 8 – Exclusion of Right of Withdrawal
The right of withdrawal may be excluded for custom-made products, perishable goods, sealed hygiene items, digital downloads, or services delivered on a specific date. This includes personalized clothing from New York Wardrobe.
Article 9 – Pricing
Prices remain valid during the offer period unless affected by VAT changes. Fluctuating market prices may lead to indicative pricing. Price increases within 3 months of the contract are allowed only if due to law; later increases allow the consumer to cancel. Import duties and taxes may be collected by couriers. New York Wardrobe does not charge VAT on such deliveries.
Article 10 – Conformity and Warranty
Products must meet contract requirements, offer reasonable usability, and comply with legal provisions. Any manufacturing defects must be reported within 14 days. Warranty terms align with the manufacturer’s policy. The guarantee does not apply in cases of misuse or unauthorized modifications.
Article 11 – Delivery and Execution
The entrepreneur will fulfill accepted orders promptly, within 30 days unless otherwise agreed. If delayed, the consumer will be informed and may cancel the contract. In case of replacement items, the right of withdrawal remains. New York Wardrobe bears the risk until delivery to the consumer.
Article 12 – Subscriptions
Consumers may cancel indefinite contracts at any time with a notice period of no more than one month. Fixed-term contracts can only be renewed with clear consent. Trial subscriptions end automatically. Contracts over one year may be canceled after one year with one month's notice.
Article 13 – Payment
Amounts owed must be paid within 7 working days unless otherwise agreed. Consumers must report inaccuracies in provided payment details. In case of non-payment, reasonable costs may be charged after prior notice.
Article 14 – Complaints
Complaints must be submitted clearly within 7 days of discovering a defect. They will be answered within 14 days. If resolution takes longer, the consumer will be informed. A valid complaint may result in replacement or repair at no cost.
Article 15 – Disputes
Contracts between the entrepreneur and the consumer are governed exclusively by French law, even if the consumer resides abroad.
